EVENT RENTAL TERMS AND CONDITIONS
These Event Rental Terms and Conditions (“Rental Terms”) apply to décor, equipment, accessories, and other rental items provided by Creative Happens Events (“Creative Happens,” “we,” “us,” or “our”) in connection with the Client’s wedding or event.
These Rental Terms supplement the Client’s signed wedding planning, event planning, or coordination agreement (“Services Agreement”). The Services Agreement, approved proposal, invoice, rental order, and these Rental Terms together constitute the agreement between Creative Happens and the Client.
1. Rentals Available Only to Creative Happens Clients
Creative Happens provides rental items exclusively to clients who have retained Creative Happens for wedding planning, event planning, or coordination services.
We do not offer standalone rentals to the general public. Rental items may only be used for the event identified in the Client’s Services Agreement and may not be transferred, subleased, loaned, or used at another event.
If the Client’s planning or coordination services are canceled or terminated, any associated rental reservation may also be canceled in accordance with the cancellation provisions of the Services Agreement and these Rental Terms.
2. Rental Reservations and Availability
Creative Happens uses an inventory-management system to track rental availability for each event date.
Rental items are reserved for the Client when:
- The Client has an active Services Agreement with Creative Happens;
- The Client completes or approves the rental order;
- Any required payment has been received; and
- The order is confirmed through the Creative Happens rental system.
Once confirmed, the selected quantities are allocated to the Client’s event and will not be offered to another client for the same rental period.
Items placed in an online cart, wishlist, proposal, or inspiration board are not reserved until the order is completed and confirmed.
Requests to add items after the original order are subject to the quantities shown as available at the time of the additional request.
3. Rental Period
The rental period is limited to the Client’s contracted event date and the delivery, setup, and retrieval schedule established by Creative Happens.
Unless Creative Happens approves otherwise in writing, rental items must remain at the event location and may not be taken home by the Client, guests, vendors, or venue personnel.
All rental items remain the sole property of Creative Happens.
4. Pricing and Payment
Rental prices will be shown on the Client’s proposal, invoice, or rental order.
Unless otherwise stated in writing:
- Rental charges must be paid according to the payment schedule in the Client’s Services Agreement or invoice.
- Rental items are not considered reserved until the required payment has been received.
- Additional items requested after the final payment date must be paid for before the event.
- Delivery, installation, room flips, relocation, pickup, retrieval, labor, candles, consumables, cleaning, and other services may be charged separately.
Creative Happens may decline to deliver or install rental items if the Client has an outstanding balance.
5. Changes to Rental Selections
Rental additions are subject to availability and may result in additional delivery, labor, setup, or service charges.
Reductions or removals must be requested in writing. Rental reductions are subject to the following terms unless the Client’s proposal states otherwise:
- Thirty or more days before the event: 75% of the canceled rental-item charges may be credited or refunded.
- Fifteen to twenty-nine days before the event: 50% of the canceled rental-item charges may be credited or refunded.
- Fourteen days or fewer before the event: rental charges are nonrefundable.
Custom, personalized, specially purchased, perishable, or consumable items are nonrefundable once ordered or purchased.
Planning and coordination fees are governed separately by the Client’s Services Agreement.
6. Event Cancellation or Rescheduling
Cancellation of the event and cancellation of Creative Happens’ planning or coordination services are governed by the Client’s Services Agreement.
If the event is rescheduled, Creative Happens will make reasonable efforts to transfer the rental reservation to the new date. All rental items remain subject to availability.
A transfer is not guaranteed. If an item is unavailable on the new date, Creative Happens may offer a comparable substitution, account credit, or refund of the unavailable item’s rental price.
Custom, personalized, perishable, consumable, or specially purchased items remain the Client’s financial responsibility.
7. Final Selections and Counts
The Client must approve final rental selections, quantities, layouts, colors, and related details by the deadline provided by Creative Happens.
After the finalization deadline:
- Reductions may not be accepted;
- Additions are subject to availability;
- Additional labor or rush fees may apply; and
- Creative Happens is not responsible for errors resulting from incomplete, late, or inaccurate information provided by the Client.
The Client is responsible for reviewing the final rental order and promptly reporting any discrepancies.
8. Delivery, Setup, and Retrieval
Creative Happens will coordinate delivery, setup, and retrieval according to the Client’s service package, proposal, venue rules, and event timeline.
The Client is responsible for ensuring that Creative Happens has timely and safe access to the venue. This includes obtaining necessary permissions and confirming:
- Venue access times;
- Loading and unloading locations;
- Parking availability;
- Elevator or stair access;
- Setup and breakdown deadlines;
- Fire-code or flame restrictions;
- Venue insurance requirements; and
- Any other venue-specific rules.
Additional charges may apply for stairs, long-distance carrying, difficult access, delayed access, waiting time, parking, after-hours retrieval, room flips, multiple setup locations, or schedule changes outside Creative Happens’ control.
9. Placement and Movement of Rental Items
Creative Happens will place rental items according to the approved design and event plan.
Once an item has been installed or placed, the Client, guests, venue staff, and other vendors may not move, dismantle, repurpose, or remove it without approval from Creative Happens.
Additional labor charges may apply if Creative Happens is asked to relocate rental items, complete a room flip, or correct changes made by another party.
10. Client’s Responsibility for Rental Items
The Client is responsible for the rental items from the time they are delivered or installed until they are retrieved by Creative Happens.
The Client must take reasonable steps to protect rental items from:
- Theft or unauthorized removal;
- Breakage or misuse;
- Water, rain, wind, or severe weather;
- Open flames or excessive heat;
- Wax, food, beverages, chemicals, or staining substances;
- Children or guests climbing, sitting, hanging, or standing on décor;
- Venue staff or vendors improperly moving or discarding items; and
- Any other use inconsistent with the item’s intended purpose.
The Client’s responsibility continues even when the damage, loss, or removal is caused by a guest, venue, vendor, or other person attending or working at the event.
11. Inspection and Reporting
Creative Happens will inspect rental items before delivery and after retrieval.
The Client or designated representative should report any visible damage, missing pieces, or incorrect quantities as soon as reasonably possible after setup. If no issue is reported before guests begin using the event space, the items will be presumed to have been delivered in acceptable condition.
Normal signs of prior use are not considered defects. Rental items are not guaranteed to be new.
12. Damage, Loss, and Replacement Charges
The Client is financially responsible for rental items that are lost, stolen, destroyed, discarded, permanently stained, damaged beyond normal wear, or returned in a condition requiring extraordinary cleaning or repair.
Charges may include:
- Cleaning or restoration costs;
- Repair costs;
- Replacement cost at current market value;
- Shipping, sourcing, and rush-order expenses;
- Lost accessories, components, packaging, or storage materials; and
- Reasonable loss-of-use costs when an item cannot be rented while being repaired or replaced.
Creative Happens will provide an itemized invoice for additional charges. Payment is due within seven calendar days unless otherwise stated on the invoice.
13. Candles and Open Flames
Candles and open flames may only be used when:
- The venue permits them;
- They comply with applicable fire and safety requirements;
- Creative Happens has approved the candle and vessel combination; and
- The candles are placed and used as instructed.
The Client may not place outside candles into Creative Happens rental vessels without prior written approval.
Real candles, LED candles, fuel, batteries, or other consumable components may be priced separately from the vase, votive, lantern, or hurricane rental.
The Client is responsible for damage caused by wax, flame, smoke, soot, heat, or unauthorized candle use. If the venue prohibits open flames, Creative Happens may substitute approved LED candles when available.
14. Outdoor Use and Weather
Outdoor placement is subject to weather, ground conditions, venue restrictions, and safety considerations.
Creative Happens may relocate, modify, delay, or decline to install an item if wind, rain, heat, unstable ground, or another condition could create a safety risk or damage the rental inventory.
The Client is responsible for providing an approved indoor or covered backup location when requested. Creative Happens is not responsible for changes to the design or layout made reasonably necessary by weather or safety concerns.
Items removed or withheld for safety reasons are not automatically eligible for a refund when Creative Happens transported the items or reserved them exclusively for the Client’s event.
15. Arches, Backdrops, and Installed Décor
Arches, backdrops, draping, signs, floral structures, and similar installations must be assembled, weighted, secured, moved, and dismantled only by Creative Happens or an approved professional.
Guests, vendors, and venue staff may not climb, hang from, lean against, modify, or attach materials to these installations.
Creative Happens may refuse an installation when the surface, location, weather, venue rule, or requested use makes the installation unsafe.
16. Venue and Vendor Coordination
Creative Happens may communicate with the venue and other vendors regarding access, placement, safety, and retrieval. However, the Client remains responsible for ensuring the venue permits the selected rental items and planned use.
Creative Happens is not responsible for:
- A venue refusing an item or installation;
- Another vendor moving or damaging an item;
- Venue staff discarding or removing rental property;
- Delays caused by venue access or another vendor; or
- Changes required to comply with venue rules.
17. Substitutions
Although confirmed rental items are reserved for the Client’s event, an item may occasionally become unavailable because it was lost, damaged, rendered unsafe, or otherwise became unusable before the event.
If this occurs, Creative Happens will notify the Client and make reasonable efforts to provide:
- The same item from replacement inventory;
- A reasonably comparable substitute approved by the Client; or
- A refund or account credit for the unavailable item if no appropriate substitute is available.
Creative Happens will not substitute an item solely for aesthetic or operational convenience after the Client’s order has been confirmed.
Minor variations in color, finish, material, dimensions, or appearance are not considered unavailability. Rental inventory is used repeatedly and may display reasonable signs of prior use.
18. Food, Desserts, Florals, and Consumable Products
Food, desserts, florals, candles, batteries, paper goods, and other consumable or perishable products are not rental property unless specifically identified otherwise.
Once ordered, purchased, prepared, delivered, or installed, these products are nonreturnable and nonrefundable.
Allergy, ingredient, and food-safety responsibilities associated with products supplied by a third-party vendor remain subject to that vendor’s policies and disclosures.
19. Taxes
Applicable sales, use, or other taxes will be charged as required by law and will appear on the Client’s invoice or rental order.
The tax treatment of an item may differ depending on whether it is rented, sold, consumed, incorporated into another product, or provided as part of a taxable service.
20. Safety
The Client agrees to follow all safety instructions provided by Creative Happens.
Creative Happens may remove, disable, relocate, or refuse to install any item that we reasonably believe presents a danger to guests, staff, vendors, the venue, or property.
Rental décor is not designed to support a person’s weight unless specifically identified for that purpose.
21. Limitation of Liability
To the fullest extent permitted by law, Creative Happens will not be responsible for indirect, incidental, special, or consequential damages arising from the rental items or their use.
Creative Happens’ total liability relating to a rental item will not exceed the amount paid by the Client for that specific rental item, except where a different limitation is required by law.
Nothing in these Rental Terms limits liability that cannot legally be limited.
22. Indemnification
To the fullest extent permitted by law, the Client agrees to indemnify and hold Creative Happens harmless from third-party claims, damages, losses, or expenses arising from:
- Misuse or unauthorized movement of rental items;
- The actions of the Client, guests, venue, or other vendors;
- Violation of venue rules;
- Unauthorized candles, attachments, or alterations; or
- The Client’s failure to follow these Rental Terms or safety instructions.
This provision does not apply to the extent a claim results from Creative Happens’ own negligence or willful misconduct.
23. Force Majeure
Events outside either party’s reasonable control—including severe weather, natural disasters, government restrictions, venue closure, transportation interruption, labor disruption, public emergency, or similar events—will be handled under the force-majeure and rescheduling provisions of the Client’s Services Agreement.
24. Relationship to the Services Agreement
These Rental Terms supplement the Client’s Services Agreement and apply specifically to rental items and related rental services.
If these Rental Terms directly conflict with the Services Agreement, the Services Agreement will control unless the Client’s rental proposal or another written document expressly states otherwise.
No change to these Rental Terms is effective unless confirmed in writing by Creative Happens.
25. Governing Law
These Rental Terms will be governed by the laws of the State of California.
Any venue or dispute-resolution requirement contained in the Client’s Services Agreement will also apply to these Rental Terms. If the Services Agreement does not contain such a provision, the parties agree that any legal proceeding will be brought in the county where Creative Happens maintains its principal place of business.
26. Electronic Acceptance
The Client’s electronic signature, checkbox acceptance, payment, or written approval of the rental order constitutes acceptance of these Rental Terms.
Electronic acceptance has the same effect as a handwritten signature.
CLIENT ACKNOWLEDGMENT
By approving the rental order or completing payment, the Client acknowledges that:
- The Client has an active planning or coordination relationship with Creative Happens;
- The rentals are being provided only for the Client’s contracted event;
- The Client has reviewed the rental selections, quantities, pricing, and event date;
- The Client understands the cancellation, damage, safety, and payment responsibilities; and
- The Client agrees to the Services Agreement and these Event Rental Terms and Conditions.
